We were proud to have hosted, on 8 April 2025, the panel discussion “Navigating New Horizons: Arbitration Developments on Corporate Ethics Amid Policy Shifts”. This panel was held in conjunction with De Gaulle Fleurance as part of this year’s edition of Paris Arbitration Week.
Our distinguished panel of speakers, comprising Peter Chow (Acacia Arbitration Chambers), Alexis Foucard (Clifford Chance), Professor Makane Mbengue (University of Geneva) and Merlin Papadhopulli (Engie), touched on a variety of topics across commercial and investor-state arbitration, including:
• Balancing between the rights of and obligations of states and investors by way of the concept of the “right to regulate”.
• The difficulties in defining the applicable standard for alleged breaches of ESG obligations
• The effect of regulatory uncertainty on supply contracts
The panel was moderated by Bruno Sousa Rodrigues (Sciences Po Law School) and Esperanza Barron-Baratech (De Gaulle Fleurance).
